|
This course aims at acquainting students with the basic legal principles applicable to the oceans. This legal regime, applicable to two-thirds of our planet, is based on a a number of multilateral conventions (1982, 1994 and 1995). The objective of the course is to study the delicate interaction between this conventional system and state practice

First the sources of international law of the sea are discussed. Subsequently the different maritime zones, all possessing a distinct legal regime, are analyzed in turn, namely: the territorial sea, the contiguous zone, the exclusive economic zone, the continental shelf, the Area, and the high seas. Also the specific regime applicable to straits used for international navigation, bays and archipelagic states is focused upon. Special attention is finally also devoted to the articles of the above-mentioned convention on the settlement of disputes, because this was the first multilateral agreement which incorporated such a detailed procedure for the peaceful settlement of international disputes

During the examination a copy of the United Nations Convention on the Law of the Sea (Montego Bay, 1982) as well as the Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 Relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks (New York, 1995) will be held available for student use
